According to Eugene, he needs a strong central computer / server to work from. I'm sure they don't have one of those at the jail.

First she has to convince Perry that Eugene is innocent.
It would seem the gun charge would still stick, and the other charge still in theory would stick if the conviction was overturned, although guess they might drop all of them, but only if she could make a deal to avoid exposing incompetence.
LOIS: You want me to sit on a story about incompetence in the DA's office in return for no jail time. <<holds out wrists>> Take me away. I don't take bribes.
I guess that would make the whole trial and conviction highly suspect.
Word of the convicted killer that his victim is still alive isn't enough to free Eugene. They've got to catch Harrison alive first.
